ELECTRONIC RECORD AND SIGNATURE DISCLOSURE AND CONSENT
From time to time, Farm Credit Illinois (FCI) may provide you certain written notices, disclosures, contracts, authorizations, acknowledgements, and other documents, which may or may not require your signature (Records). Described below are the terms and conditions for providing you Records electronically. Please read the information below carefully and thoroughly.
Getting paper copies
At any time, you may request a paper copy of any Record FCI provided, or made available, to you electronically. You will have the ability to download and print Records FCI sends to you. You may request delivery of paper copies from FCI by following the procedure described below. There is no fee for paper copies.
Withdrawing your consent
If you consent to receiving Records from FCI electronically, you may at any time withdraw your consent and receive Records only in paper format. You may withdraw your consent to receive Records electronically by following the procedures described below.
Consequences of changing your mind
If you elect to receive Records only in paper format, FCI will no longer be able to provide certain Records to you electronically, which may slow the speed at which you can complete transactions with FCI.
Discretion to send notices and documents via non-electronic mediums
Regardless of whether you agree to this Electronic Record and Signature Disclosure and Consent (ERSD), FCI retains the right to provide Records via any medium allowed by law. If you agree to this ERSD, FCI may provide Records to you electronically via the electronic mail address, or other secure portal location, provided to or by FCI.
How to contact Farm Credit Illinois:
You may inform FCI of (i) changes to the email address where electronic Records should be sent, (ii) requests for paper copies of electronic Records, and (iii) withdrawal of your consent to receive Records electronically by taking one of the following actions:
- Notify your local FCI regional office; or
- Send an email message to ask@farmcreditil.com.
To protect your information, FCI may need to contact you to effectuate your request. Once FCI is notified, it will initiate its process for responding to your request, which may take up to thirty days to complete.
Required hardware and software
With respect to electronic Records concerning transactions primarily for personal, family, or household purposes, any information required by statute, regulation, or other rule of law to be made available to you in writing may be made available to you using the DocuSign system. The minimum system requirements for using the DocuSign system may change over time. The current system requirements are found here: The current system requirements are found here.
Generally, the system requirements in place for DocuSign for any given time will allow access to all FCI electronic Records. However, for transactions and information not described above, your and FCI’s conduct may allow hardware and/or software other than that required by DocuSign to be utilized.
Acknowledging your access and consent to receive and sign documents electronically
By agreeing to transact business electronically with FCI, you agree to the terms of this ERSD and that:
- Use of electronic Records entail risks (including the risk of interception by a third party) and you hereby release FCI from all liability relating to the electronic provision or transmission of Records;
- You have read this ERSD and consent to receive any and all Records electronically pursuant to the terms of this ERSD until the earlier of (i) the termination of your relationship with FCI or (ii) you withdraw your consent pursuant to the terms of this ERSD;
- You can access and read this ERSD, which is presented similarly to other electronic Records that FCI provides electronically; and
- You can print this ERSD on paper, save this ERSD, send this ERSD to a location for printing, or otherwise preserve this ERSD for future reference and access.
